Our Commitment
GRIFFE respects authors' rights and complies with the legal framework applicable to platforms operating in Brazil: Marco Civil da Internet (Lei 12.965/2014), Lei 9.610/98 (Direito Autoral), and LGPD (Lei 13.709/2018). We respond promptly to legitimate notifications and to judicial orders.
Legal framework — when GRIFFE removes content
- Judicial order (Marco Civil Art. 19): on receipt of a specific judicial order GRIFFE removes the content within the deadline set by the court.
- Image rights / private nudity without consent (Marco Civil Art. 21): GRIFFE removes the content out of court within 24 hours of a valid notification from the affected party. This is the only out-of-court takedown required by Brazilian law.
- GRIFFE Terms of Service: GRIFFE may remove uploads that violate its own ToS — copyright infringement, plagiarism, unauthorized samples — under our internal moderation policy. This is voluntary and based on our own assessment, not a takedown obligation.
Filing a content notification (out-of-court)
If you believe a pack on GRIFFE infringes your rights, send an email to legal@griffe.com.br with:
- Identification of your work — title, registration number (if any), or detailed description with links to the original.
- URL of the GRIFFE pack you believe infringes (full link).
- Your contact information — full legal name, CPF/CNPJ, email, phone, and address.
- Statement of good faith declaring under the laws of Brazil that you are the rights holder or authorized to act on their behalf, and that the use is unauthorized.
- Signature — physical or electronic.
Notifications outside the cases listed above (Art. 19 + Art. 21) do not create a legal obligation for GRIFFE to remove content. We may still review and act under our own ToS — but Brazilian law requires a judicial order for out-of-court takedown of ordinary copyright disputes. False notifications may give rise to civil and criminal liability under Lei 9.610/98 and the Brazilian Penal Code.
What happens next
- We acknowledge receipt within 48 hours.
- If the case falls under Art. 21 (image rights / private nudity), we remove the content within 24 hours of receipt.
- For other cases, we triage under our ToS and may remove the content if the breach is clear; otherwise we await a judicial order.
- The producer is notified of the takedown and may submit a counter-notification.
- The incident is recorded against the producer's account (3-strike policy below).
Counter-notification
If your content was removed and you believe the removal was a mistake or that you have the rights to use the material, send a counter-notification to legal@griffe.com.br with:
- Identification of the removed content and its former URL
- Statement that you believe the removal was a mistake or misidentification
- Your full legal name, CPF/CNPJ, address, phone, and email
- Consent to the jurisdiction of the courts of São Paulo / SP, Brazil
- Physical or electronic signature
We forward valid counter-notifications to the original complainant. If they do not file a judicial action within 10 business days, we may restore the content.
Impact on buyers
Notice for buyers
If a pack you bought is removed for infringement, your download access may be revoked and downloaded files should not be used in new productions. GRIFFE makes reasonable efforts to refund affected purchases per the refund policy. We are not liable for losses resulting from the use of infringing material before the takedown.
Repeat-infringer policy
GRIFFE applies a three-strike policy:
- 1st strike: content removed, written warning to the producer.
- 2nd strike: content removed, account placed on probation (new uploads require manual moderation).
- 3rd strike: account permanently terminated, all content removed, pending payouts forfeited per ToS.
We may terminate sooner in cases of willful or commercial-scale infringement, at our sole discretion.
Authors' moral rights
Under Lei 9.610/98 (Direito Autoral), authors' moral rights — including authorship recognition — are inalienable and non-transferable. Producers using GRIFFE always retain authorship of their original work, regardless of license tier sold.
